DUI, DWAI, Traffic and Driving Under the Influence of Drugs/Cannabis
A DUI can be life and career altering. There is a possible loss of driving privileges, jail, increased insurance and lots of court fees. A DUI is also one of the most common criminal charges because the police are incentivized to arrest people for DUI and almost all street officers are trained in DUI detection. Every evening the police are on heightened alert to stop anyone who commits even the most minor traffic infraction in the off-chance the driver has been drinking or smoking cannabis. This is especially true in states where cannabis is legal, like Colorado. Once you are charged, the weight of the government is brought down upon you. We have been in the trenches of DUI law and, particularly, cannabis driving issues for over two decades. When the case has merit, we have the skill and fortitude to take the case to trial. DUI/Cannabis
We are among the most experienced cannabis law firms in the country and teach cannabis law to other attorneys. Based on this experience we have specialized knowledge about cannabis and driving, including several studies that established that cannabis does not increase crash risk and that cannabis drivers often perform as well as “sober” drivers in driving tasks. Some examples of our work:
Acquitted a client at trial who was accused by the state patrol of driving under the influence of driving by having the state expert admit that there was little or no correlation between THC blood levels and impairment
Acquitted a client at trial based on cross examination of the arresting officer using the obvious video evidence of the client’s sobriety despite consuming cannabis
Acquitted a client at trial based on the testimony of co-workers who stated the client was sober while at work, despite testing positive for THC
Negotiated dismissal of the charges by pointing out the evidence of sobriety in the police reports and video evidence
Negotiated dismissal of the DUI charge by pointing out that the roadside tests were not consistent with cannabis use
